Terms of Service

In short: you pay now and you can talk to Santa right away. You can cancel the order only as long as you haven't used the service at all, meaning Santa hasn't called yet and you haven't talked with him; after the first call, the money is no longer refunded. Santa's voice is generated with artificial intelligence.
1. Who we are
SantaPicksUp.com is a service of MIKETOON STUDIO S.R.L., a company registered in Romania (European Union), tax ID (CUI) 48183590, trade register number J2023009206402 (EUID ROONRC.J2023009206402), with its registered office at Aleea Călărașilor no. 5, block G, floor 3, apt. 54, Sibiu, Sibiu County, postal code 550344, Romania.

2. What we offer
A conversation in which a voice of Santa Claus talks live, in English, with your child. Santa greets them by name and uses the details you give us: their age, a good deed, what they wished for.
Santa is not a real person. The voice and the answers are generated automatically, with artificial intelligence, during the conversation. The service is audio only, without video, and takes place in your browser, from your account.
You can use the service in these ways:
- Santa rings you. In your account you choose “Have Santa call” and Santa rings right in your browser.
- Your child calls Santa. After that, your child can call Santa from your account, for as long as you have minutes, until Christmas Eve.
Everything in the browser. No phone number is needed. You need a device with a microphone and speakers, a recent browser and an internet connection, and you must allow the browser to use the microphone. It works until Christmas Eve.
3. Who can buy
You can buy if you are at least 18 years old and you are the child's parent or guardian, or have their permission. The service is for parents and guardians: children use it only together with, and under the supervision of, an adult, and only an adult can create an account or place an order.
4. Prices, payment and invoice

Examples: 1 child costs $5, 2 children $10, 3 children $15, 4 children $20, 5 children $25. Minutes add up in a single shared credit for the whole account.
The prices shown are the final prices you pay, in US dollars. Payment is by card, through Stripe. We don't see or keep your card details. Your bank may add its own currency conversion fees.
The contract is concluded when the payment is confirmed. We issue the invoice through Oblio and send it to you by email. The receipt or email from Stripe is not an invoice.
5. How it works
- The order. You choose how many children will talk with Santa and you pay.
- Your account. Right after you pay, we take you to your account. There you sign in, fill in the children's details and talk with Santa.
- Santa rings you. In your account you choose “Have Santa call” and Santa's call rings in your browser. If nobody answers, no minutes are used.
- Your child's calls. Your child can call Santa from your account, on any device where you are signed in. If there are no minutes left, Santa can't take the call until you add some.
Calls take place until December 24th, 2026. A call lasts as long as you have minutes in your account or as long as the child wants to talk; unused minutes stay in your account, as credit, until December 24th, 2026. If nobody speaks for 20 seconds, Santa says goodbye and hangs up.
Make sure your device's microphone and speakers work and that your internet connection is stable when the call starts.
6. Minutes and validity
- Minutes are used by the second, only for the time the call is actually in progress.
- When the minutes run out, Santa says goodbye and the call ends.
- You can buy extra minutes from your account at any time, until December 24th, at $2 per minute (the price is shown in your account before you pay). Purchased minutes are added to those in your package and can be used for any call, whether Santa rings you or your child calls him.
- Minutes can be used until December 24th, 2026. Minutes not used by then expire and are not refunded, except for the cases in section 9.
- If a call is interrupted because of a problem on our side, write to us and we'll restore the lost minutes.
7. Call recordings
Every call is recorded, so you can listen to it and keep it as a memory. The recording appears in your account, where you can listen to it, download it and send it on.
By paying the order you agree that your child's calls with Santa are recorded. If other adults take part in the call, for example on speaker, please let them know.
On December 31st, 2026, at 11:59 pm (Romania time), we delete all recordings and all of the children's details. We email you beforehand so you can download them. Details are in the Privacy Policy.
8. How Santa talks
Santa is configured to follow these rules:
- he doesn't promise specific gifts; he only says the elves are preparing a surprise;
- he doesn't ask for addresses, the school or other personal data;
- he doesn't scare the child or threaten them, for example with the naughty list;
- he doesn't talk about religion, politics or violence;
- if a child says something worrying, he gently urges them to talk to a parent right away and ends the call kindly.
Because the answers are generated automatically, Santa may sometimes say something inappropriate or inaccurate. The service doesn't replace supervising your child. Please be nearby when they talk with Santa.
9. Cancellation, withdrawal and refunds
Cancelling the order
You can cancel the order, without giving a reason, only as long as you haven't used the service at all: Santa hasn't called yet and you haven't talked with him for a single second, neither when he rang you nor when you called him. In that case you get all your money back. Write to us at [email protected] from the email you used at checkout, or press the cancel button in your account.
After the first call
A call with Santa is a personalised service, made in your child's name and carried out at your request, and Santa's voice is generated on the spot. That is why, once you have used the service, the order can no longer be cancelled and the money is no longer refunded, not even for the minutes that are left. Unused minutes expire on December 24th, 2026, without a refund.
Your rights as a consumer
By ordering, you expressly ask for the service to begin on the date you choose in your account, and you acknowledge that once it has been fully performed you can no longer withdraw (for consumers in the European Union: Directive 2011/83/EU on consumer rights, implemented in Romania by Government Emergency Ordinance no. 34/2014). The rules above don't limit the rights that mandatory law in your country gives you. If you think you are entitled to more, write to us at [email protected] and we'll look at your case.
How you get your money
We refund within 14 days of your request, to the same card you paid with. We don't keep any fee.
10. Discounts
The prices shown on the site are the prices you pay. We don't currently offer discount codes on this site. If we do, the conditions will be published together with the offer.
A discount applies only to the order for which it was granted and can't be applied afterwards to an order that has already been paid.
11. Groups and events
For more than 5 children, kindergartens, classes or events we make a separate offer. The price, length and conditions are agreed in writing before payment.
12. Liability
We do everything we can so that calls work and sound good. We are not responsible for what is outside our control, for example:
- your internet connection or device doesn't work;
- the microphone is blocked or doesn't work;
- your browser is out of date or not supported;
- the details about the child are inaccurate.
To the extent the law allows, our liability for an order does not exceed the amount paid for it. This limit does not apply where the law does not permit it, for example for acts committed intentionally or with gross negligence, or for death or personal injury. Your statutory consumer rights remain unaffected.
13. Copyright
The texts, images, voice and the Santa character on SantaPicksUp.com belong to MIKETOON STUDIO S.R.L. or to our partners. The call recordings are for your personal and family use. You can keep them and send them to your loved ones, but you can't use them commercially.
14. Changes
We may update these terms. For an order that has already been paid, the terms in force on the day of payment apply, except for changes that are in your favour.
15. Complaints and disputes
If something went wrong, write to us at [email protected]. We'll reply within 7 business days.
The contract is governed by Romanian law, without affecting the mandatory consumer protection rules of the country where you live. If we can't agree, and you are in the European Union, you can turn to Romania's National Authority for Consumer Protection (anpc.ro) or to an alternative dispute resolution body (ADR). Wherever you live, you can also contact your card issuer. You can also go to the competent courts in Romania.
